This unit explores the increasingly complex, competitive, and global business environment and looks at why it is vital for managers to master high-level contract negotiation and management. There is a particular focus on large scale, high price projects that are of a sensitive nature, whether that is cultural, economic, or political. This unit aims to provide you with the knowledge and tools to be able to confidently move in this area of contracts and contract law.

Skills / Knowledge

  • Demonstrate a high order of skills in creating the structure of a commercial contract and explaining its key terms, and its role in leadership and management.
  • Analyse the different lifecycle stages of a contract and explain the essential elements of a valid and enforceable contract.
  • Critically evaluate a range of contractual disputes and consider alternative dispute resolution systems.
  • Formulate risk control strategies when things go wrong - i.e. how to enforce a contract, how to terminate a contract and what damages or remedies, if any, may be available in the event of one or more parties defaulting.
  • Predict when courts will intervene when the requirements of a contract have not been satisfied. The equitable remedy of estoppel.
  • Create flexible and creative approaches in the application of knowledge and skills to new situations, to resolve problems and to think rigorously and independently.
